at 5:00pm at the Chamber of
Commerce
Conference Room
The Site Manager(s) of the Pagosa Springs Farmers Market with full support of the SOS Board of Directors shall enforce these Rules and Regulations. The Board of Directors will interpret these regulations according to the best interest of the market.
I. Vendor
a. Local farms and gardens in the Pagosa Springs area and Archuleta County
b. Regional farms in the Four Corners area including LaPlata County and New Mexico.
c. Brokering at the discretion of the Board.
1. Products being sold from the Western Slope may be considered.
II. Merchandise
a. Edible – vegetables, fruits, meat, herbs.
1. Seedlings and starter plants are included.
b. Processed food shall comply with all Health Regulations. Refer to the State Regulations.
c. Non-edible shall be limited to flowers; cultivated and wild.
d. Vendors are asked to post their growing methods
1. Certified Organic, grown with organic methods, or grown conventionally.
2. Vendors are encouraged to profile their farming practices. Tell people who you are with photos, written accounts, and verbal information.
III. Fees
a. Cost for one space for a vendor selling products from a backyard family garden or community garden and not selling to a retailer or at another venue shall be $60 per season
1. paid in full at the first market of the season OR
2. $5 per market paid each week of participation.
b. Cost of one space for a commercial or brokering vendor selling at other retail venues shall be $120 per season
1. paid in full at the first market of the season OR
2. $10 per market paid each week of participation.
IV. Licenses
a. All vendors are responsible for the necessary licenses and permits required for their booth.
b. The Pagosa Springs Farmer’s Market will provide an umbrella business license for small vendors who do not wish to have an individual business license for a one time fee of $5.00 per year. (To acquire a business license in the Town of Pagosa Springs the fee is $45 for the first year and $20/yr thereafter.)
c. Vendors operating under the Market umbrella license must report their income and pay sales taxes weekly to the Market.
V. Health Regulations
a. All vendors must follow Health Code Regulations, and it is their responsibility to be in compliance.
b. All Food Vendors are responsible for the appropriate inspections by the State Health Department and must have the appropriate certification, permits, and licenses.
c. Any prepared foods sold at the market must be prepared in compliance with the Health Department Guidelines.
d. Liability for all such products rest solely with the vendor producing and selling them.
e. Smoking by the vendors will not be permitted at the market.
VI. Vendor Booth
a. Vendors may park and use tailgate or table for selling and use one parking space.
b. Vendors may erect a canopy and use two parking spaces.
c. The market opens at 4:00pm with an announcement by the Site Manager. No sales are allowed before opening.
VII. Location/Day/Time
a. The Pagosa Farmer’s Market location is the 400 block on Pagosa St. in the parking lot.
b. Markets will be held each Friday beginning June 27 and continuing through September 26. EXCEPTION: The market will not be held on Fri. July 4th.
c. The Market will open at 4:00 p.m. and close at 7:00 p.m.
VIII. Upkeep
a. Vendors are responsible for the upkeep of the general market area located near or in their booth area.
b. Vendors should supply their own trash receptacle and dispose of accumulated trash.
IX. Consumer Comments
a. Consumer comments should be directed to the Site Manager to be brought before the board for discussion.
X. Vendor Comments and Concerns
a. All suggestions, complaints, and comments must be presented in writing and given to the Site Manager, signed by the vendor with their name, address and telephone number.
b. All suggestions, complaints, and comments will be considered at the next scheduled board meeting.
